horror_tang said:
Next time tell him to arrest you. Never let them search your vehicle.
Bad advice. Let a cop do whatever he wants to do. However, make it a point to clearly state for the record that you are not giving him PERMISSION to search your vehicle. That way, anything he found can later be thrown out as an illegal search and seizure. (Federal law)
If you are being pulled over, try and pull into a shopping plaza parking lot. They can't get you for anything unless they were summoned by the owners of the plaza for a crime committed on that private property.
Bad advice. 1), you're referring MA private property law, not NH. Secondly, the law provides that cops cannot go after someone for somthing they're doing ON private property without a resident complaining. For example, in MA they can't write you a ticket for blasting your radio in a grocery store parking lot unless someone calls and complains. They can harass you about it, but can't ticket you. However, there are some exceptions, like parking in a fire lane, etc... ALSO, they can pull you over on private property and bust you for something you did if it was not on private property. In other words, even in MA, he would still get pulled over in a parking lot, since the original justification was that he was speeding.
Finally, do not waste money on a lawyer unless you are up on murder charges. You can talk to the prosecutor yourself and get a better deal than any lawyer could get you.
Bad advice, AGAIN! A lawyer, even court appointed, can get charges dropped. DA and prosecutors can only commute, continue, or lessen charges. ALWAYS ALWAYS ALWAYS get a lawyer for ANY JAILABLE OFFENSE, or anything that will affect your criminal record if found guilty. Pleading to a continuance for a first time DUI seems like a great idea, til you get pulled over 30 years later with a few beers on your breath and find out it STILL counts as a second offense, and can cost you a few years in jail.
